The Canon opens with Misuse of Authority.
This was not a thematic decision.
It was an evidentiary one.
Any system that continues to act while refusing to respond has already failed the minimum condition of legitimacy. Everything that follows is downstream of that error.

Authority does not collapse because it is challenged.
It collapses because it becomes non-responsive.
When power:
continues to decide without dialogue,
escalates without correction,
substitutes process for reality,
and treats silence as neutrality,
it ceases to govern.
It imposes.
This is not controversial.
It is simply inconvenient.
What This Position Establishes
SWANK POSITION PAGE 001 establishes the Canon’s first constraint:
Authority is legitimate only while it remains responsive.
Once responsiveness ends, ethical authority ends with it.
No additional misconduct is required.
No bad intent need be shown.
No further harm need be proven.
The failure is complete at the point of silence.
What This Is Not
This position is not:
a legal submission,
an advocacy document,
a personal narrative,
or a critique of individual actors.
It is an observation of structural behavior repeated across safeguarding, regulatory, administrative, and enforcement systems.
Those recognizing it immediately tend to do so because they have encountered it.
Those disputing it tend to do so because they rely on it.
Canonical Consequence
By placing this position first, the Canon makes the following unavoidable:
Non-responsiveness is not neutral
Process does not substitute for engagement
Escalation without response is not safeguarding
Harm that follows is not accidental
Once authority stops responding, it is no longer entitled to continue.
This is the point at which constraint begins.
Closing Filing
The Canon does not open with ideology.
It opens with listening.
Institutions do not lose legitimacy by being challenged.
They lose legitimacy by refusing to respond.
Everything else in the Canon assumes this is already understood.
