Subject: Formal Complaint – Systemic Failure by Westminster and RBKC Social Services to Comply with Data Access Rights Under UK GDPR

I write to submit a formal complaint to the Information Commissioner’s Office (ICO) regarding the ongoing and unlawful failure by both Westminster Social Services and RBKC Social Services to comply with their obligations under:
The UK General Data Protection Regulation (UK GDPR), and
The Data Protection Act 2018.
This failure is not mere bureaucratic inconvenience.
It constitutes obstruction, discrimination, and a cultivated culture of procedural opacity.
๐ 1. Non-Compliance: A Catalogue of Indifference
On multiple occasions, I have issued formal Subject Access Requests (SARs) to:
Westminster Social Services;
RBKC Social Services.
These requests have been met with:
Deafening silence,
Vague refusals,
And a total absence of lawful justification.
At no point have I received:
The full documentation to which I am legally entitled;
Nor a credible explanation for this failure.
The implication is chillingly clear:
These authorities are either ignorant of their legal obligations, or choosing to ignore them.
๐ 2. Legal Framework, Blithely Ignored
The conduct of these departments constitutes a breach of:
Article 15 of UK GDPR – Right of access by the data subject;
Data Protection Act 2018 – Obligation to respond to SARs within one calendar month;
Freedom of Information Act 2000 – Duty to facilitate public transparency.
No extensions were claimed.
No legal exceptions cited.
Only silence — and procedural stonewalling — have been offered.
๐ 3. Impact of Withholding Information: Obstruction by Design
The consequences of this obstruction have been both material and profound:
Obstruction of legal rights — denying me access to essential documents;
Denial of procedural fairness — preventing me from challenging or correcting harmful inaccuracies;
Emotional distress — born of battling Kafkaesque structures of concealed decision-making.
This is not oversight.
It is the administrative erasure of accountability.
๐ 4. Actions Requested of the ICO
Accordingly, I respectfully request that the ICO:
Launch a formal investigation into both boroughs’ SAR compliance practices;
Order the immediate disclosure of the data requested;
Consider the imposition of sanctions or penalties for systemic noncompliance;
Advise me of available legal remedies should these authorities persist in unlawful conduct.

An outline of investigatory steps to be provided within 28 days.
Should this matter remain unresolved,
I reserve the right to initiate formal legal proceedings for non-compliance,
